Terms of Service

1. Overview

This website is operated by Eco Deco Australia. Throughout this website, the terms “Eco Deco,” “we,” “us” and “our” refer to Eco Deco Australia.

These Terms of Service apply to your use of our website and to purchases made through our website, by email, by quotation, in person or through any other sales channel operated by Eco Deco Australia.

By accessing our website, placing an order or purchasing a product from us, you agree to these Terms of Service together with our:

  • Refund and Return Policy

  • Shipping, Delivery and Collection Policy

  • Privacy Policy

  • Warranty Policy

  • Installation and Product Information Policy

Nothing in these terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.

2. Eligibility to Purchase

By placing an order, you confirm that:

  • You are legally capable of entering into a binding agreement

  • The information supplied with your order is complete and accurate

  • You are authorised to use the selected payment method

  • You have reviewed the product details, dimensions and quantity before purchasing

Where an order is placed on behalf of a business, company or other organisation, the person placing the order confirms that they have authority to bind that organisation.

3. Product Information

We make reasonable efforts to ensure that product descriptions, specifications, dimensions, prices and images are accurate.

However:

  • Colours may appear differently due to photography, lighting and screen settings

  • Natural-looking grain, marble, stone and decorative patterns may vary between panels

  • Texture, embossing, sheen and pattern placement may vary between production batches

  • Dimensions and weights may be subject to reasonable manufacturing tolerances

  • Lifestyle images may include furniture, fittings, décor and accessories that are not included with the product

  • Product images may be digitally created or enhanced for illustration purposes

Customers should review the full product description and specifications before ordering. Where colour or finish is particularly important, customers should inspect an available sample or physical product before purchasing.

Product images are for illustration purposes only. Eco Deco sells only the products expressly identified in the product description or order confirmation.

4. Product Suitability

Customers are responsible for determining whether a product is suitable for their intended location, application, substrate and project requirements.

Information provided on our website is general product guidance and is not a substitute for professional building, design, engineering, waterproofing or installation advice.

Before ordering or installation, the customer or installer should consider:

  • The intended room and application

  • The condition and suitability of the wall or substrate

  • Waterproofing requirements

  • Exposure to heat, sunlight, moisture or chemicals

  • Applicable building laws, codes and standards

  • Fire-performance requirements for the particular building

  • Required adhesives, sealants, trims and finishing products

  • The manufacturer’s installation and maintenance instructions

The fact that a panel is described as waterproof or moisture resistant does not mean that the complete wall, substrate or building system is waterproof.

5. Measurements and Quantity Calculators

Any product calculator, coverage calculator or quantity estimate provided by Eco Deco is intended as a general guide only.

Calculator results depend on the measurements and information entered by the customer. Calculators may not account for:

  • Cutting waste

  • Pattern positioning

  • Damaged or unusable sections

  • Openings, corners, columns or unusual wall shapes

  • Installation methods

  • Future repairs

  • Installer preferences

  • Batch variations

  • Additional material required for errors or breakages

Customers are responsible for checking all measurements and confirming the required quantity with their installer before ordering.

Eco Deco is not responsible for shortages or excess quantities resulting from incorrect measurements, customer inputs or failure to allow sufficient installation waste, except to the extent required by law.

6. Ordering Sufficient Products

Customers should order enough product to complete the entire project, including an appropriate allowance for cutting, waste, future repairs and installation requirements.

Products purchased at different times may come from different production batches and may have variations in colour, pattern, texture or finish.

Availability of the same design or batch at a later date cannot be guaranteed.

7. Orders and Acceptance

Submitting an order does not necessarily mean that the order has been accepted.

An order becomes accepted when we:

  • Issue an order confirmation;

  • Accept payment;

  • Confirm acceptance of a quotation; or

  • Begin preparing the products for collection or dispatch.

We may contact the customer to confirm order details, availability, delivery requirements or payment information before accepting an order.

Where we cannot fulfil an order, we will contact the customer and provide an appropriate refund for any unavailable products.

8. Quotations

Unless otherwise stated, quotations:

  • Are valid for the period shown on the quotation

  • Are based on the information provided by the customer

  • May be subject to stock availability

  • May exclude delivery, unloading, installation or other services unless expressly included

  • May be revised if the product quantity, destination, scope or requirements change

A quotation is not an order confirmation until it has been accepted and any required payment has been received.

9. Prices and GST

Unless otherwise stated, prices displayed for Australian customers are in Australian dollars and include GST where applicable.

Delivery, freight, palletisation, handling, special-order and other charges may be added separately and will be displayed or communicated before the order is finalised.

We may correct genuine pricing, description or calculation errors. Where an error affects an order already placed, we will contact the customer before proceeding and provide the option to continue at the correct price or cancel the affected item for a refund.

10. Payment

Payment must be made using an approved payment method.

Orders may not be prepared, dispatched or released for collection until cleared payment has been received, unless Eco Deco has approved written credit arrangements.

Customers are responsible for any fees charged by their financial institution, payment provider or card issuer.

11. Deposits and Special Orders

Deposits may be required for pre-orders, custom orders, special orders, large-volume orders or products reserved specifically for a customer.

Any deposit terms, payment stages and cancellation conditions will be stated in the quotation, invoice or order confirmation.

Specially ordered or reserved products may not be eligible for change-of-mind cancellation or return. This does not affect any rights available under the Australian Consumer Law.

12. Pre-Orders and Incoming Stock

Products advertised for pre-order are not currently available for immediate collection or dispatch.

Arrival, unloading, customs clearance and availability dates are estimates only and may be affected by:

  • Manufacturing delays

  • Vessel or transport delays

  • Port congestion

  • Customs or biosecurity inspections

  • Severe weather

  • Industrial action

  • Carrier delays

  • Events outside Eco Deco’s reasonable control

We will provide reasonable updates if we become aware of a material delay.

A delay does not remove any rights the customer may have under Australian Consumer Law. Where Eco Deco cannot supply a pre-ordered product within a reasonable period, the customer may be entitled to cancel and receive a refund.

13. Order Changes and Cancellations

Requests to change or cancel an order must be made as soon as possible.

We cannot guarantee that an order can be changed or cancelled after:

  • Products have been allocated or reserved

  • A special order has been placed with the manufacturer

  • Products have been picked, packed or palletised

  • Delivery has been booked

  • Products have been dispatched

  • Collection has been arranged

Approved cancellations may be subject to reasonable costs already incurred, where lawful and disclosed to the customer.

Faulty-product rights under Australian Consumer Law are not affected.

14. Delivery and Collection

Delivery and collection are governed by our Shipping, Delivery and Collection Policy.

Customers must provide complete and accurate delivery or collection information and ensure that the location is safe and reasonably accessible.

Unless expressly included in writing, delivery does not include:

  • Installation

  • Carrying products through a property

  • Carrying products upstairs

  • Mechanical unloading

  • Removal of packaging

  • Removal of existing materials

  • Site preparation

  • Storage after delivery

Risk in the products generally passes to the customer when the products are delivered to the agreed location or collected by the customer or the customer’s authorised carrier, subject to applicable law.

Ownership does not pass until Eco Deco has received full payment.

15. Inspection Before Installation

Customers must inspect products before cutting, drilling, modifying or installing them.

The customer should check:

  • Product code and design

  • Colour and finish

  • Quantity

  • Dimensions

  • Visible damage

  • Pattern variation

  • Manufacturing or surface concerns

Products from several boxes should be compared and arranged before installation to achieve the preferred distribution of patterns and tones.

A product that appears incorrect, damaged or defective should not be installed. Contact Eco Deco as soon as reasonably possible with photographs and order details.

Installing a product may make it more difficult to determine whether damage existed before installation. However, this requirement does not remove any rights under Australian Consumer Law.

16. Installation

Products must be stored, handled, prepared and installed in accordance with:

  • The manufacturer’s current instructions

  • Eco Deco installation guidance

  • Adhesive and sealant manufacturers’ instructions

  • Applicable building laws, codes and standards

  • Appropriate waterproofing requirements

  • Accepted trade practices

Installation should be completed by a suitably experienced person. Licensed trades must be used where required by law.

Eco Deco is not the installer unless installation services are expressly included in a separate written agreement.

We are not responsible for workmanship performed by independent installers, contractors or tradespeople who are not employed by Eco Deco.

17. Independent Installers and Referrals

Eco Deco may provide contact details for independent installers or tradespeople as a convenience to customers.

Unless expressly stated otherwise:

  • The installer operates independently from Eco Deco

  • The customer is responsible for selecting and engaging the installer

  • The installation agreement is between the customer and installer

  • The installer determines their own availability, pricing and work methods

  • Eco Deco does not guarantee the installer’s workmanship or suitability

Nothing in this section limits liability that cannot lawfully be excluded.

18. Returns and Refunds

Returns, discretionary returns, restocking fees and refunds are governed by our Refund and Return Policy.

We do not generally accept returns for change of mind. In limited circumstances, a return may be approved at our discretion where the product remains unopened, unused, undamaged and in its original packaging.

Approved discretionary returns are subject to the conditions and 5% restocking fee stated in our Refund and Return Policy.

These restrictions do not apply where the customer is entitled to a remedy under Australian Consumer Law.

19. Manufacturer Warranty and Consumer Guarantees

Products sold by Eco Deco are covered by the applicable manufacturer’s warranty.

The coverage, conditions and duration of a manufacturer’s warranty may vary by product and are determined by the written warranty terms applying to that product.

Manufacturer warranties are provided in addition to rights and remedies available under Australian Consumer Law. They do not replace or restrict those rights.

Customers may contact Eco Deco to make a warranty or consumer guarantee claim. We may work with the manufacturer to inspect, assess and resolve the claim.

20. Website Availability

We aim to keep our website available and accurate, but we do not guarantee uninterrupted or error-free access.

We may update, suspend or remove website content where reasonably necessary, including to:

  • Correct errors

  • Update product details

  • Maintain website security

  • Change discontinued or unavailable products

  • Perform technical maintenance

These changes do not affect orders already accepted, except where required to correct an error or comply with law.

21. Intellectual Property

Unless otherwise stated, the website and its contents—including logos, branding, product descriptions, text, graphics, layouts, photographs and downloadable materials—are owned by or licensed to Eco Deco Australia.

Content may not be copied, reproduced, republished, distributed or used commercially without written permission, except as allowed by law.

22. Reviews and Customer Content

Where customers submit reviews, photographs or other content, they confirm that:

  • The content is accurate and based on their genuine experience

  • They have permission to provide the content

  • The content does not infringe another person’s rights

  • The content is not unlawful, threatening, misleading or defamatory

Eco Deco may moderate or remove content where reasonably necessary.

We will obtain permission before using identifiable customer project photographs for marketing where consent is required.

23. Prohibited Use

Customers must not use the website:

  • For unlawful or fraudulent activity

  • To transmit malicious code

  • To interfere with website security

  • To collect information about other users without permission

  • To infringe intellectual property or privacy rights

  • To submit false orders or payment details

24. Liability

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded.

To the extent permitted by law, Eco Deco is not responsible for loss caused by:

  • Incorrect measurements supplied by the customer

  • Installation contrary to instructions

  • Unsuitable substrates or site conditions

  • Inadequate waterproofing

  • Incorrect adhesives, sealants or accessories

  • Work performed by an independent installer

  • Improper transport, storage or handling after delivery or collection

  • Normal product or batch variation

  • Uses for which the product was not designed or recommended

Where liability can lawfully be limited, it will be limited only to the extent permitted by applicable law.

25. Severability

If any provision of these terms is found to be unlawful, invalid or unenforceable, that provision will be read down or removed to the minimum extent necessary. The remaining provisions will continue to apply.

26. Changes to These Terms

We may update these Terms of Service from time to time.

The terms applying to a purchase will generally be those published or provided when the order was placed, except where a change is required by law or agreed with the customer.

27. Governing Law

These Terms of Service are governed by the laws of Queensland, Australia.

The parties submit to the non-exclusive jurisdiction of the courts of Queensland and any courts entitled to hear appeals from them.
